1. Subject

1.1 These General Conditions govern the Contract for the online sale of products offered by Michele Matranga sas through the online platform www.michelematranga.it.

1.2. Pursuant to Articles 7 and 12 of Legislative Decree no. 70/2003, Customers are informed that the service provider on the Website subject to the General Conditions is Michele Matranga sas, holder of a P.S. license, duly registered with the C.C.I.A. of Palermo with VAT number 04109520827, economic and administrative repertory number 171940, with registered office in Palermo, via Francesco Lo Iacono, 91, 90144 Palermo.

2. Definitions

2.1. In these General Conditions, terms not otherwise defined shall have the meanings assigned to them below.

“Acceptance” means the contractual acceptance of the Purchase Order by Michele Matranga sas, following verification of the Product’s availability.

“Michele Matranga sas Account” means the customer’s personal account accessible from the Website and allocated in the “My Account” section. From the Michele Matranga sas Account, the Customer has the ability to check their Purchase Orders and modify their personal information.

“Customer” means the user who has successfully completed the registration process on the Website, choosing their access credentials. The Customer has the ability to navigate within the Website and their Michele Matranga sas Account and to use all services available on the Website from time to time. The Customer must complete their profile with personal data before concluding the Contract.

“Civil Code” means Royal Decree 16 March 1942, no. 262 and subsequent amendments and integrations.

“Consumer Code” means Legislative Decree 6 September 2005, no. 206 and subsequent amendments and integrations.

“Content” means all information, videos, images, sounds, music, photographs, software, newsletters (containing useful news aimed at using the Website and therefore forming an integral part of it), animations, databases, design and content, trademarks, logos, technical solutions adopted, graphic realizations, look & feel, structure, and any other part already made or to be made, whether registered or not, covered or not by copyright or legally protected, published on the Website or any other material (in any form) or service made available through the Website to Customers, including informative sheets relating to Products, images or descriptions relating to Products as well as third-party trademarks or logos of manufacturers or suppliers of Products.

“Contract” means, collectively, these General Conditions of sale (including any document referred to in these General Conditions), the Purchase Order, and the Acceptance, as well as any additional conditions published on the Website and additional rules and/or instructions on the individual Product pages or, in any case, published on the Website.

“Michele Matranga sas” is the company regularly registered with the C.C.I.A. of Palermo, holder of a P.S. license, VAT number 04109520827, economic and administrative repertory number 171940, with registered office in Palermo, via Francesco Lo Iacono, 91.

“Purchase Order” means the contractual proposal made by the Customer for the purchase of a Product available on the Website and sent to Michele Matranga sas in accordance with the purchase procedure set forth in Article 5 below.

“Product or goods” means any precious object, jewel, watch, or accessory offered for sale on the Website and any other product offered for sale on the same Website.

“Website” means the website www.michelematranga.it.

“Shipper” means the shipper Ferrari, Ups, or the different shipper chosen from time to time by Michele Matranga sas, at its sole discretion, which will handle the delivery of Products purchased on the Website.

3. General Conditions

3.1. The General Conditions applicable to the sale on the Website of the Products are those published on the Website in the “General Sales Conditions” section at the date of sending the Purchase Order by the Customer. It is the Customer’s responsibility to verify and read the applicable General Conditions before proceeding with each Purchase Order.

3.2. The Customer is requested to print a copy of the General Conditions applicable to each Purchase Order and/or store them on durable medium.

3.3. The General Conditions may be amended by Michele Matranga sas at any time. Any amendments and/or new Conditions will be effective from the date of their publication in the “General Conditions” section of the Website.

3.4. These General Conditions do not govern the sale of products and/or the provision of services by parties other than Michele Matranga sas that are present on the Website through links, banners, or other hypertext links. Before engaging in commercial transactions with such parties, the Customer must check their sales conditions. Michele Matranga sas is not responsible in any way for the provision of services and/or the sale of products by such parties. Michele Matranga sas does not exercise any control and/or monitoring on websites accessible through such links. Michele Matranga sas is therefore not responsible for the content of such sites or for any errors and/or omissions and/or violations of the law by them.

3.5. The services provided on the Website, as well as the Contract and the General Conditions, are in Italian.

4. Registration on the Website

4.1. In order to purchase the Products offered for sale on the Website, the Customer must register on the Website itself, creating their own Michele Matranga sas Account, providing an email address and a password for logging in, after having read the Information on the processing of personal data. The registration credentials, which can be modified by the Customer at any time by accessing their Michele Matranga sas Account, are personal and cannot be transferred to third parties. Registration on the Website is free.

4.2. The Customer must complete the registration procedure on the Website, even at a later time but in any case before sending their first Purchase Order on the Website, by accessing their Michele Matranga sas Account and providing the requested information and personal data.

4.3. The Customer guarantees that the information provided during the registration procedure on the Website is complete, correct, and truthful. The user agrees to indemnify Michele Matranga sas from any compensatory obligation, sanction arising from and/or in any way connected to the violation by the Customer of the rules on registration on the Website. The user is solely responsible for accessing the Website using the registration credentials and is directly responsible for any damage or harm caused to Michele Matranga sas or third parties by improper use, loss, misappropriation by others, or failure to protect the adequate confidentiality of their registration credentials. All operations carried out using the registration credentials are considered to be carried out by the Customer to whom the registration credentials refer.

4.4. The Customer expressly authorizes Michele Matranga sas to send all communications relating to the Contract, as well as to the Purchase Order, Acceptance, and the status of execution of the Order, to their email address.

4.5. The Customer can view the Purchase Orders made in their Michele Matranga sas Account, as well as manage and save personal data.

4.6. The Customer may cancel their registration on the Website at any time by sending an email to info@michelematranga.it.

4.7. Michele Matranga sas reserves the right to refuse, at its sole discretion, the registration of any Customer. Michele Matranga sas also reserves the right not to accept orders, from anyone, that are abnormal in relation to the quantity of products purchased or the frequency of purchases made on the Website.

4.8. By registering on the Website, the Customer may agree to receive, through the contact details provided, any invitations to participate in sales and commercial proposals from Michele Matranga sas. At any time, the Customer may request not to receive further invitations to participate in sales. In this case, the Customer may still participate in sales by accessing directly through their credentials on the Website.
